General rental conditions – ed. 1/2025

a) A&E-Bikehome undertakes, upon payment of the agreed fee, to deliver the pedal-assisted bicycle – e-bike – to the Customer in full working order and excellent condition.

b) The Customer declares, by signing this contract, that they:

Agree to make the payment;

Have inspected the bicycle;

Have received the bicycle in excellent and fully functional condition.

c) The Customer/User is required to report any anomalies detected.

2. Requirements

a) The Customer must provide:

A valid ID for each user of the bicycle, which will be kept on file;

A credit/debit card or bank card for payment of the agreed fee and the security deposit.

b) Physical fitness and technical competence of the person intending to use the bicycle.

By renting the bicycle, the user declares they have adequate ability and experience.

c) The obligation to use lights and wear a high-visibility reflective vest or braces in tunnels and from 30 minutes after sunset until 30 minutes before sunrise (Art. 182 Highway Code).

d) The use of a helmet during the rental, even for adults.

3. Liability

a) The Customer is responsible for the bicycle until it is returned, including any damage caused to themselves, the bicycle, or third parties/things during its use.

b) In case of loss, theft, damage, or destruction of the bicycle or accessories, the Customer must compensate A&E-Bikehome for the damage, as quantified:

According to the cost of repair in case of damage. This includes, but is not limited to, damage to the frame, wheels, fork and shock absorbers, mechanical parts, linkages, punctures, scratches, etc.

c) In case of theft and/or loss, the Customer must present the original police report to A&E-Bikehome and pay an amount equal to the value of the stolen/lost bicycle. The report must be filed promptly, otherwise the full value will be charged. If the item is recovered within 48 hours, A&E-Bikehome will refund the amount already paid.

d) The Customer/User agrees to use the bicycle with care, common sense, and diligence, avoiding damage to things and/or others.

e) The Customer agrees to park and store the bicycle in a safe place, day and night, not leaving it unattended and protected from bad weather.

f) If the Customer deems the bicycle unsuitable, they must immediately notify A&E-Bikehome staff at the location where the issue is found.

g) Failure to return the bicycle at the agreed time or end of the rental, without exceptional and justified cause (e.g., accident, breakdown, natural events), will be considered theft/misappropriation and reported to the competent Judicial Authority.

h) A&E-Bikehome declines any liability for damage to people and/or property during the entire rental period.

i) It is the Customer’s responsibility to return the bicycle to the rental or delivery location, even in case of mechanical or electrical failure, breakage, or other malfunctions.

4. Prohibitions

a) Use of the rented bicycle for purposes other than recreational, touristic, and occasional is prohibited.

b) Transfer, sublease, sale, lending, or any other form of third-party mediation is prohibited.

c) The use of software to increase the maximum speed of the pedal-assisted bicycle beyond 25 km/h is prohibited.

d) Leaving the bicycle unattended is prohibited.

5. Conditions

a) A&E-Bikehome may carry out inspections during use of the bicycle without prior notice to the Customer/User.

b) The bicycle must be returned at the time and in the manner agreed with A&E-Bikehome. The bicycle is picked up and returned by the Customer/User at the same location. Delivery to a different location is possible by agreement, with any additional costs borne by the Customer/User.

c) The Customer/User agrees:

To ride the bicycle properly and prudently, without endangering themselves or others;

To comply with the Highway Code (Art. 140 and following).

d) The Customer exempts and holds A&E-Bikehome harmless from any and all liability and/or compensation claims arising from use of the bicycle. During rental, the Customer/User has no insurance coverage, and the bicycle is not insured under civil liability insurance (RCA). Users must comply with road laws.

e) A&E-Bikehome disclaims all responsibility for improper use or violations of the Highway Code. They are not liable for damage to persons or property caused by the customer/user during the rental.

f) The Customer agrees to pay the rental fee in cash, credit card, or debit card upon pick-up.

g) If the Customer fails to comply with the contract or delays payment, A&E-Bikehome has the right to demand immediate return of the bicycle.

6. Booking

a) Orders may be placed only by:

Online Booking:

Must be made at least 24 hours before the event using the booking system on www.ae-bikehome.com;

Booking via text message, chat, or email is also allowed.

7. Cancellation and Modification

a) Customer cancellations are allowed under the following conditions:

No charge if cancelled at least 24 hours before the event;

A 50% charge applies if cancelled less than 24 hours before the event;

Order modifications are allowed at any time with no fees;

A&E-Bikehome reserves the right to cancel the booking, with a full refund to the customer, if necessary for the safety of property or personnel.

8. Refunds

a) A&E-Bikehome is not required to refund the booking cost for anomalies due to mechanical or electronic issues, as it is a service provider, not a manufacturer. If verified faults prevent use of the bicycle, a voucher of equal value or discount on a future booking may be issued.

9. Personal Data Processing

a) In accordance with Article 13 of Legislative Decree No. 196/2003, personal data collected for this rental agreement will be processed in compliance with said law.

b) The data controller is A&E-Bikehome, located in Riva del Garda (TN), Località Ischia, 21.

c) The data processing will follow principles of fairness, legality, and transparency.

d) Data will be processed electronically and/or manually for the following purposes:

Management of obligations under this contract;

Advertising, market research, or internal commercial communication;

To allow Authorities to act in case of Customer violations of the Highway Code or other laws.

e) The Customer may exercise their rights under Article 7 of Legislative Decree No. 196/2003 at any time.
